Terms of Service

Welcome to Health and Beauty AI (the "App"). These Terms of Service (the "Terms") form a binding agreement between you and Health and Beauty AI ("we," "our," or "us") governing your access to and use of the App and any related services (collectively, the "Service"). By creating an account, signing in, or using the Service in any way, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you meet this requirement. The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly.

If you are between 13 and 17, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. Notify us immediately at service@healthbeauty.app if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or applicable law.

3. Subscriptions, Auto-Renewal, and Billing

Certain features of the Service are available only through a paid subscription. By purchasing a subscription you authorize the applicable payment processor — Apple App Store for iOS, Google Play for Android, or Stripe for web — to charge the recurring subscription fee to your selected payment method.

4. Health and Wellness Disclaimer

The Service is for informational and self-tracking purposes only. It is not a medical device, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment. AI-generated insights, recommendations, meal analyses, supplement information, and any other content within the App are estimates based on general data and do not account for your individual medical history.

Always consult a qualified healthcare professional before making changes to your diet, exercise routine, supplement regimen, or treatment plan. Never disregard professional medical advice or delay seeking it because of something you read or saw in the App. If you believe you are experiencing a medical emergency, call your local emergency number immediately.

The Service is not intended for the diagnosis, treatment, or prevention of any eating disorder. If you are struggling with disordered eating, please contact the National Eating Disorders Association (NEDA) Helpline at 1-800-931-2237 or your local equivalent.

6. Your Data and Tracking

You retain ownership of the personal health and wellness data you submit to the Service. By using the Service you grant us a worldwide, non-exclusive, royalty-free license to host, process, and use your data solely to operate, maintain, improve, and personalize the Service for you.

Our Privacy Policy describes in detail what we collect, how it is used, and the limited circumstances under which it may be shared (with our subprocessors that power AI inference, payment processing, crash reporting, and email delivery). We do not sell your personal information.

You can request export or deletion of your account and associated data at any time through the in-app account settings or by contacting service@healthbeauty.app. Account deletion is permanent.

7. AI-Generated Content

Outputs produced by the Service's AI features are generated by third-party large language models — specifically OpenAI (GPT models) and Google (Gemini models) — and may be inaccurate, incomplete, or inappropriate. Health and nutrition data you submit, including any Apple HealthKit-derived data, is forwarded to these providers solely to generate your response; it is never used for advertising, model training, or data sale. We make no representations or warranties as to the accuracy, completeness, or fitness for any particular purpose of AI-generated content. You are solely responsible for evaluating and verifying any AI output before relying on it.

8. Apple HealthKit

The Service may integrate with Apple HealthKit to read step counts, sleep analysis, and body weight data that you explicitly authorize. This data is used solely to power your in-app health logging and AI coaching features. HealthKit data is never used for advertising or marketing purposes and is never sold to third parties. See our Privacy Policy — Section 3 for full details.

9. Third-Party Services

The Service integrates with third-party services including Apple HealthKit, Google Sign-In, Apple Sign-In, Apple App Store payments, Google Play payments, Stripe, OpenAI, Google Gemini, Firebase, Vercel, Sentry, and Resend. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.

10. Intellectual Property

The Service, including its software, design, branding, and content (excluding your user-generated content), is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination your right to use the Service ends immediately. Sections that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF DATA, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.

14. Indemnification

You agree to defend, indemnify, and hold us and our officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any rights of a third party.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and we waive the right to participate in a class action or class-wide arbitration. Either party may bring an individual claim in small-claims court for disputes within the court's jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you through the App or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
